Chapter 7 (Properties and Accounting)

  1. Article 28 (Types of properties)
    The properties of the Association shall be classified as follows, while the base properties of the Association are as shown in the appendix;
    1. 1. Base properties
      1. A. The land and buildings owned by the Association;
      2. B. Donations, either in cash or in kind, made with a designation as base properties;
      3. C. Securities with monetary values, tangible properties, or other assets which have been approved by the General Meeting to be included as a part of the Base Properties, including the income or credits created through the operation of the regular properties;
    2. 2. Regular properties
      1. A. The registration fees and membership fees paid by members;
      2. B. Monetary and in-kind donations;
      3. C. Income from Base Properties;
      4. D. Other income from business activities, etc.
  2. Article 29 (Management of properties)
    1. ① When selling, assigning, renting, exchanging the properties of the Association, providing the properties of the Association as collaterals or changing their purposes, or when waiving obligations or rights of the Association, such a decision shall be made through a vote at a General Meeting.
    2. ② Any changes regarding the Base Properties shall be governed by the rules applicable to the revision of the Articles of Association.
  3. Article 30 (Financing)
    1. ① The sources of the financing for the maintenance and operation of the Association are as follows;
      1. 1. The registration fee and membership fee paid by members;
      2. 2. Donations; and,
      3. 3. Other incomes of the Association.
    2. ② If the Association wishes to oblige itself with debts outside of its budget, such shall be subject to the approval by the General Meeting and the Minister of the Land, Infrastructure, and Transport.
  4. Article 31 (Fiscal terms)
    The fiscal term of the Association shall be in accordance with the fiscal term of the Government.
  5. Article 32 (Budget planning and closing)
    1. ⓛ The Association shall have its business plan and budget plan for the fiscal term passed by the Board of Directors and approved by the General Meeting no later than one month before the beginning of the fiscal term. Provided that the projects which involve central government expenditure shall require the approval of the Minister of Land, Infrastructure, and Transport.
    2. ② The Association shall have its business performance and closing reports passed by the Board of Directors and approved by the General Meeting within two months from the end of the applicable fiscal term.
  6. Article 33 (Accounting audits)
    Auditors shall conduct two accounting audits every year.
  7. Article 34 (Reporting of business plans and business performances)
    The Association shall, within two months from the end of a fiscal term, submit the following documents to the Minister of Land, Infrastructure, and Transport;
    1. 1. The business plan for the following fiscal term and a budget plan including incomes and expenditures;
    2. 2. The business performance report and the income/expenditure statement of the current fiscal year;
    3. 3. A list of properties as of the end of the current fiscal year; and,
    4. 4. An audit report for the current fiscal year.
